The Supreme Court on Thursday appeared skeptical of a ruling by a federal appeals court that rejected former President Donald Trump’s claim that he has absolute immunity from criminal charges based on his official acts as president.

In March, Trump won a high court decision reversing a Colorado ruling that said an anti-insurrectionist provision of the Constitution should keep him off the ballot. As he spoke then from his home in Florida, Trump was already looking ahead, calling for the justices to side with him on immunity as well.

Both the attorney for Trump and the Department of Justice representative agreed that the president must have broad immunity from prosecution for actions taken in his capacity as commander-in-chief.

While the important question of timing in Trump’s appeal looms, consider that the justices have many other things to decide over the next couple of months.

The case, to be argued Thursday, stems from Donald Trump’s attempts to have charges against him dismissed. Lower courts have found he cannot claim for actions that, prosecutors say, illegally sought to interfere with the election results.
