Jury deliberations resumed Monday in the Daniel Penny subway chokehold trial, but jurors will only need to consider one lesser charge. The jury was deadlocked most of the day Friday on the other more serious charge Penny faced.

A Manhattan judge asked a deadlocked jury on Friday to return next week to consider the lesser charge of criminally negligent homicide against the 26-year-old former Marine in the death of 30-year-old Jordan Neely.

Supreme Court Justice Maxwell Wiley approved the Manhattan District Attorney's Office request to drop the second-degree manslaughter charge because the panel of seven women and five men could not come to a unanimous decision after four days in the jury room.
